内容提要

本文在总结当代西方国际法的基础上，认为当代国际法与国内法的关系是以"二元论"为基础的，国际法调整国家间关系的这个本质仍然没有变。当代西方国际法的三大主题是国际维和与武装冲突、发展与环境、民主与人权。显然，在民主与人权的理解上，发达国家与发展中国家有着不同的认识。围绕着这三大主题的，则是国际合作、对话与改革三大主旋律。此外，在研究当代西方国际法时，应当重视欧洲大陆的国际法与美英国际法思想间的微妙差异。

Abstracts

This paper, starting from an introduction to modern western public international law, holds that the relationship between public international law and law of states still bases on the theory of dualism. The main topics of modern public international law are international peace keeping and armed conflicts, the dilemma between development and environment protection, democracy and human rights. Of course, the industrial countries and the developing countries have different values regarding the conception of democracy and human rights. The main objects of modern public international law are&nbs p;international cooperation, dialogue and reform. The difference between the continental Europe and Anglo-American countries should not be omitted by studying western public international law.
