ing about the aim of penalty, many scholars think retribution and prevention as opinions on the aim of penalty. In this article, through comparison between the aim and essence of penalty, the author think retribution is the essence of penalty and maximum prevention is the aim of penalty. The aim of penalty is limited and realized by essence of penalty.
